Introduction to Terms and Conditions

AC Agrotech Sdn Bhd and its affiliates (collectively, “us”, “we”, or “our”) operates

aqiqahcentre.com (“Aqiqahcentre”, “Website”), including any content, to you, subject to the following Terms and Conditions (“T&C”), which may be updated by Us from time to time. By accessing the website and/or any pages thereof, you agree and understand that you shall be bound to our terms and conditions. If you do not agree to our terms and conditions, you may cease all activities pertaining to the website 

This document outlines the terms and conditions between you and AC Agrotech which governs your participation as a user, customer or agent with us. In addition to the terms and conditions, you may be subject to any guidelines, rules, notices and agreements applicable to such services by us. It is important that you read and fully understand our terms and conditions before proceeding with our services. 

Interpretation

AC Agrotech	means the Operator of aqiqahcentre.com, a company registered in Malaysia and having its business address at Malaysia Global Innovation & Creativity Centre (MaGiC), Blok 3730, Persiaran APEC, 63000 Cyberjaya, Selangor Darul Ehsan
Agents	means any Individual or registered entity appointed by the Company to promote the Company’s website and services
Agent Agreement	Means the service goods agreement between the Agent and Company
Company	means AC Agrotech
Customers	means an individual or entity that desires to purchase the Services or Goods offered by the Company
Disclaimer	means the notice for website disclaimer looking on our website
Event of Force Majeure	means an event, not within the control of the Party affected, which that Party is unable to prevent, avoid or remove, and shall mean: war (whether declared or not), hostilities invasion, act of foreign enemies, insurrection, revolution, rebellion, military or usurped power, civil war or acts of terrorism; natural catastrophe including but not limited to earthquakes, floods and subterranean spontaneous combustion or any operation of the force of nature, lightning and exceptionally inclement weather;  act of authority whether lawful or unlawful, compliance with any law or governmental order, rule, regulation or direction, curfew restriction, expropriation, compulsory acquisition, seizure of works, requisition, nationalisation;  act of God, plague, epidemic, pandemic, natural disaster such as but not limited to violent storm, cyclone, typhoon, hurricane, tornado, blizzard, earthquake, volcanic activity, landslide, tidal wave, tsunami, flood, damage or destruction by lightning, drought; riot, commotion and disorders, criminal damage, sabotage, strike, lock out, labour unrest or other industrial disturbances (affecting the performance of this Agreement) which are not the fault of the Parties, which causes, or can reasonably be expected to cause any Party to fail to comply with its obligations,
Parties	means the Customer, Agent and Company and each of them individually shall be a “Party”
Privacy Policy	means the document on how we collect and process your personal data
Sales Agreement	means the contract for services or goods purchasing between the customer and us
Services	means the Aqiqah services and Qurban goods that are offered by the website
Services Provider	means AC Agrotech
Service video	video proof of the Aqiqah service
Third Party Provider	means our third-party service and goods providers, such as our merchandise providers, our suppliers, our vendors and other goods and services providers that we have legally appointed.
Terms and Conditions	means the terms and conditions available on the website as from time to time amended by us
Registration Form	means the registration form submitted by the user in order to complete the purchasing of services or goods
Website	means aqiqahcentre.com

Access to our website

You are solely and entirely responsible for the use of this website and access to all

information, and any content that you upload, publish, share or display through the website. You represent and warrant that you own or have otherwise obtained all necessary rights, permission, authorization, or licenses to do so when posting or submitting any content, information, or other materials via the website and application. You shall not upload, share, publish any information, or material which are illegal, false, inappropriate, offensive, abusive, defamatory or which shall give rise to civil or criminal liability or infringe the rights of another.

Collection and Processing of your personal data

We only collect personal information that is provided voluntarily by you so that we are able to provide our services. We collect data through registration forms in order to customize our products and services. Once you have registered or submitted personal information to us, we will only use this information in the manner prescribed relevant to our services. Your personal information is not used for other purposes, unless we obtain your permission, or unless otherwise required or permitted by law or professional standards.

Customer terms and conditions

We offer Aqiqah and Qurban Goods on our website and users will have the option to purchase any number of goats for Aqiqah or Qurban. Where a registered Customer desires to purchase the Services and Goods offered, they shall be bound by the Sales Agreement. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, our services, and website with prior notice to the customer. 

We shall deliver to the Customer a video as proof of the Aqiqah service (“Service Video”). This video shall be delivered online to the customer through their registered phone number  or the customer’s registered email address. The method of delivery of the video shall vary and it will be up to us to decide how we send the video out to the customer. The Customer shall also receive complimentary goods in the form of a wooden certificate together with their purchase. The complimentary goods shall be delivered by post to the customer at the customer’s registered address. For Qurban packages, additional RM30 will be charged for wooden certificate.

Agent terms and conditions

The Company appoints the Agent subject to the terms of the Agent Agreement to act as an

exclusive Agent in the marketing of the website and the services that are offered on the website. The Agent agrees to put forth his best efforts to promote the Company’s website and Services. Agent shall perform the services under the general direction of the company and the company shall determine, in its sole discretion, the manner and means by which the services are accomplished, subject to the express condition that Agent shall at all times comply with applicable law.

Indemnity

You agree to indemnify and hold the AC Agrotech Sdn Bhd and its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any and all liabilities, losses, damages, claims, penalties, fees, fines, costs, and expenses including without limitation to reasonable legal fees, that may arise in connection with your use of this website and your failure to comply with any provisions of our terms and conditions.

Proprietary Rights

We are the owner of all intellectual property rights in this Website, and in the material published on it. Those works are protected by copyright laws and treaties in Malaysia and around the world. All such rights are reserved. You agree not to reproduce, duplicate, copy, sell or exploit any portion of our website, content, information, without prior consent of AC Agrotech Sdn Bhd. 

Force Majeure

If any such Event of Force Majeure Event occurs, the affected Party will give the other Parties notices and will use commercially reasonable efforts to minimize the impact of any such event.

Limitation of Liability

We will not be liable for any indirect, special, consequential, or punitive damages (including lost profits) arising out of or relating to our T&C or the transactions it contemplates (whether for breach of contract, tort, negligence, or other form of action) and irrespective of whether the we have been advised of the possibility of any such damage. In no event will our liability exceed the price paid by Customer for the Services giving rise to the claim or cause of action.

Notices

Any notice or other communication given or made to any Party shall be in writing and delivered by hand, sent by courier service or sent by certified or registered mail, return receipt requested, to the address stated in the registration form and or to another address as that Party may subsequently designate by notice and shall be deemed given on the date of delivery.

General Information

These T&C (including the guides, rules, notices, agreements and other terms referred to herein) constitute the entire terms and conditions between you and us in relation to their subject matter, superseding and extinguishing any prior agreements, arrangements, undertakings of any nature, between you and us, whether oral or written in relation to such subject matter. You may also be subject to additional terms and conditions. The T&C and the relationship between you and us shall be governed by the laws of Malaysia. 

Any failure by Us to exercise or enforce any right or provision of the T&C shall not constitute a waiver of such right or provision. If any provision of the T&C is found to be invalid, the parties nevertheless agree that the parties‘ intentions as reflected in the provision shall be given effect to the fullest extent practicable, and the other provisions of the T&C remain in full force and effect. The section titles in the T&C are for convenience only and have no legal or contractual effect.

You may not assign or transfer any of your rights or obligations, or subcontract the performance of any of your obligations, under these T&C. We may assign or transfer any right or obligation, or subcontract the performance of any of its obligations, under these T&C to any third party at any time without your consent (such consent hereby being given).
